terms & conditions of business

  • Our payment terms are strictly 14 days from date of invoice.
  • Work on any project will commence only upon receipt by us of written acceptance of a quotation. Any acceptance of quotation is deemed to include acceptance of our standard terms and conditions.
  • Total Focus liability to a Client or any other third party arising out of services provided by Total Focus and for any other claim shall be limited to a sum not to exceed the payment received by Total Focus for the service provided giving rise to the claim.
  • No company can ever guarantee turnout. If minimum numbers are an absolute requirement it is incumbent on the commissioning company to request an element of over recruitment.
  • No shows will still be charged on group recruitment unless it is proved that the quality of recruitment has had a material effect on the turn up rate.
  • No shows on depth recruitment will be charged at 50% of the fee unless it is proved that the quality of the recruitment has had a material effect on turn up rate.
  • Quotations are valid for 30 days from date of issue. If the terms of reference or methodologies employed are changed, we reserve the right to amend our quotation accordingly.
  • All quotations are made exclusive of VAT at the prevailing rate and all quotations are given in £ Sterling. All invoices must be settled in £ Sterling and any associated bank charges for clearance of ex UK invoices are also chargeable.
  • If quotations are requested in currencies other than £ Sterling these can be illustrative only as exchange rates may vary from day to day.
  • If a project is deemed to place Total Focus Limited at any undue risk, we reserve the right to demand that all or part of our invoice be payable on commission. In such circumstances payment must be made within 7 days and any balance will be invoiced upon completion.
  • Any additional costs (incentives, transport, venues etc) that we agree to pay on behalf of our clients in the first instance are subject to a handling charge of 15%
  • Total Focus Limited reserves the right to suspend, withhold or cancel any work for a client where invoices have not been settled in accordance with our standard terms and conditions.
  • Late payment will result in Total Focus Limited exercising our statutory rights for debt recovery under the late payment legislation
  • Information about our clients may be passed over to our bankers/financiers for the purposes of obtaining credit insurance, credit reference searches, credit control or any other protection of our interests
  • Total Focus Limited shall not be liable for any delays, failures, losses or damage of any kind whatsoever in the provision of any services where said delay arises from any cause beyond the reasonable control of the Company. Such causes include but are not restricted to Acts of God or of the public enemy, fires, floods, adverse weather, earthquakes, traffic or transport disruption or failure, illness, epidemics, quarantine restrictions, strikes or other industrial action, freight embargoes, electrical cuts or shortages, communication equipment or systems failures, acts or omissions of sub-contractors or other third parties or any other circumstances beyond it’s control
  • In the event of a project being postponed or cancelled after commissioning, cancellation fees will be levied at the following rates:
    • After project set up but prior to the commencement of fieldwork 10% - 20% dependent on work involved.
    • More than five clear working days – disbursements and supplier (including recruiter) cancellation charges only
    • 4 – 5 clear working days – 50% of recruitment fees plus any disbursements and supplier cancellation charges
    • 3 clear working days or less – 100% of recruitment fees plus any disbursements and supplier cancellation charges.
  • Any issues arising from any project must be addressed with Total Focus within 5 days of the incident taking place.
  • Any changes to an original field specification must be made in writing to protect both parties
  • Total Focus shall in no circumstances be liable for any failure or defective working of audio or visual equipment or for any subsequent cost incurred.
